The Colorado Department of Revenue, Division of Taxation, will hold a public rulemaking hearing on the new and revised income tax rules listed below at 10:00 a.m. on May 8, 2025.
This hearing will be conducted virtually and will be recorded. Those interested in attending the hearing must register to participate virtually. The Department has created a Virtual Rulemaking Hearing Guide that provides additional information for participants.
You can access the previous workgroup recording, comments submitted to the Department, and other materials through the public drive. The rulemaking hearing recording will also be posted on the public drive after it is held.
Proposed Rules:
- Rule 39-22-516. Innovative Motor Vehicle and Innovative Truck Credits. The purpose of this revised rule is to update the guidance regarding the quarterly electronic report that must be submitted to the Department, make clear that the applicable sales tax is calculated on the full purchase price without reduction for the compensation provided by the assignee to the purchaser or lessee, and explain the consequences for the assignee if an assigned credit is disallowed by the Department.
- Rule 39-22-555. Electric Bicycle Tax Credit. The purpose of this new rule is to provide guidance regarding the electric bicycle tax credit.
- Rule 39-22-629. Advance Payments of Income Tax Credits. The purpose of this new rule is to establish procedures that allow a taxpayer to elect to receive advance payments of applicable income tax credits.
- Rule 39-22-567. Quantum Facility Investment Credit Recapture. The purpose of this new rule is to provide clarification regarding the conditions under which the Department will disallow a credit under section 39-22-567(10), C.R.S., and require recapture.
- Rule 39-22-601.5–1. Federal Partnership Adjustments. The purpose of this rule is to provide guidance regarding reporting and payment requirements established for partnerships and partners relating to federal adjustments.

The Department will accept oral and written comments on these proposed rules. Oral comments will be accepted by video and telephone conference at the hearing. Written comments may be submitted to dor_taxrules@state.co.us in advance or in lieu of oral commentary at the hearing and will be accepted until 5:00 P.M. on May 8, 2025.
