Please remember that you must claim the state sales tax refund (TABOR refund) when filing your state income tax return. If you claimed a 2023 refund, the TABOR refund will be combined and issued out with your refund. Unlike the 2022 Colorado cashback, no separate check will be issued.

On April 1, 2021, the Colorado Department of Revenue, Division of Taxation, adopted temporary emergency rules to comply with Executive Order D 2021 075, which amends the due date for certain individual income tax payments due to the continued presence of COVID-19 in Colorado. The rules also clarify the extension of filing individual income tax returns. Executive Order D 2021 075 specifically directs the Department to promulgate and issue emergency rules to amend the due date for individual income tax payments for tax year 2020 to May 17, 2021. Thus, emergency rules are necessary.

The emergency rules, as well as the statement of emergency justification and adoption, can be accessed using the hyperlink below and can be found on the Department's website. The emergency rules will be published in the Colorado Register on or before May 10, 2021.
